Massachusetts Supreme Judicial Court
Commonwealth v. Fernandes
July 21, 2023
Summary
The court affirmed the first-degree murder, armed-assault, and firearm convictions and upheld the denial of the defendant's postconviction motions, concluding that the secret recordings were lawfully obtained, the challenged evidence was properly admitted or harmless, and no constitutional or ineffective-assistance error warranted relief. It vacated three assault-by-dangerous-weapon convictions as duplicative lesser-included offenses. The court also found no substantial likelihood of a miscarriage of justice from the unpreserved CSLI, discovery, closing-argument, public-trial, or business-record claims.
