Massachusetts Supreme Judicial Court

Commonwealth v. Brum

August 10, 2023

Summary

The court affirmed the defendant's conviction for assault and battery by means of a dangerous weapon. It held that the victim's girlfriend's recanted grand jury testimony was admissible as both a prior inconsistent statement and, for her video identification, a prior statement of identification, even though she did not witness the stabbing. The court also rejected the defendant's remaining evidentiary and prosecutorial-misconduct claims, finding either no error or no prejudice. No separate opinions were filed.
