Danshin v. State

Summary

The Supreme Court of Maryland held that the trial court erred by refusing to instruct the jury on defense of others. The defendant’s recorded police interview, viewed in the light most favorable to him, supplied some evidence for each element of that defense, including his belief that the victim posed an imminent lethal threat to the person he sought to protect. The court reversed the intermediate appellate judgment and remanded for a new trial. No separate opinions were filed.
