Town of Bel Air v. Bodt

Summary

The Court of Appeals held that the Town of Bel Air Commissioners properly determined that the citizens’ document was not a valid petition for referendum under the Town Charter and that they could make that determination by a verbal motion recorded in the minutes. Accordingly, the circuit court’s judgment was vacated and the case remanded for entry of a declaratory judgment consistent with this opinion. The Court also clarified that the Charter does not permit a referendum on only part of an ordinance.
