Summary

The Supreme Court of Maryland held that the circuit court abused its discretion by implicitly vacating a prior partial summary judgment ruling in Riley’s favor on the Small Section and then entering judgment against him without addressing whether modification was necessary to prevent manifest injustice. The Court also held that the Appellate Court improperly directed reconsideration of the Association’s prescriptive-easement counterclaim because the Association had not cross-appealed its dismissal and the counterclaim was independent of the title claims. The judgment was reversed in part and the matter was remanded for revised instructions.
