Summary

The Court affirmed the judgment of the Appellate Court of Maryland, holding that the settlement agreement unambiguously required the Hospital to submit a report containing the agreed language and therefore prohibited contradictory or materially inconsistent code-generated language. Whether the Hospital breached that obligation by using the disputed code-generated statements presented a jury question, so summary judgment on that claim was improper. The Court also held that the physician’s broad release covered his claim that the Hospital failed to provide a timely fair hearing. Justice Gould joined in the judgment only.
