Summary

The court held that a Harford County public-school teacher may simultaneously serve as a member of the Harford County Council. Charter § 207 was ambiguous as to whether employment by the county Board of Education constituted employment in State or County government, and the court resolved that ambiguity in favor of the elected candidate's eligibility. The court also held that the common-law doctrine of incompatible positions did not apply because neither position supervised, appointed, removed, or set the compensation of the other.
