Summary
The Court of Appeals of Maryland held that a wrongful-death plaintiff alleging medical negligence must prove by a preponderance of the evidence that the negligence proximately caused the decedent’s death. Because the evidence showed that the decedent’s metastatic cancer was fatal and did not establish a greater-than-fifty-percent likelihood of survival absent the alleged negligence, the claim was an unrecognized loss-of-chance claim and summary judgment was proper. The court affirmed the intermediate appellate court.
