Supreme Court of Maryland

Richardson v. State

August 29, 2022481 Md. 423

Summary

The Court held that Richardson abandoned his backpack when, after an officer picked it up, he fled without asking that it be returned or indicating an intent to reclaim it, so the warrantless search was permissible. The Court also held that the cell-phone warrant violated the Fourth Amendment's particularity requirement because it authorized an unrestricted search of the phone, but the evidence was admissible under the good-faith exception because the officers reasonably relied on the incorporated affidavit and no controlling Maryland decision had yet addressed the defect.
