The Court of Appeals affirmed the lower court's decision that Antonio McGhee did not receive ineffective assistance of counsel because his trial lawyer's failure to object to a CSI‑effect voir dire question was not deficient performance under the Strickland test. The Court declined to apply the later Charles, Atkins, and Stabb decisions retroactively to McGhee's 2007 trial. Consequently, the post‑conviction grant of a new trial was reversed.
