Supreme Court of Maryland

Becker v. Falls Road Comm. Ass'n

August 26, 2022

Summary

The Court held that collateral estoppel did not bar approval of the 2018 development plan because competent, material, and substantial evidence established significant changes from the previously denied plan. The Board of Appeals improperly displaced the ALJ's factual findings and credibility determinations when it reversed approval on an on-the-record review. The Court therefore reversed the judgment of the Court of Special Appeals.
