Summary

The Court of Appeals held that collateral estoppel did not bar approval of the 2018 development plan because competent, material, and substantial evidence showed significant changes from the previously rejected plan. The Board of Appeals improperly reversed the administrative law judge by failing to defer adequately to the ALJ’s factual findings and credibility determinations. The Court therefore reversed the judgment reinstating the Board’s decision.
