Supreme Judicial Court of Maine
Roger K. Moreau v. Town of Parsonsfield
October 22, 20242024 ME 75
Summary
The court held that Moreau’s Rule 80B appeal was timely because the Zoning Board of Appeals had not fully resolved all issues until its later meeting. On the merits, the court held that Moreau’s proposed commercial use required the private access road serving his rear lot to comply with the ordinance’s commercial road standards, including a sixty-foot right-of-way, which Reed Lane lacked. The court therefore vacated the Superior Court’s judgment and remanded for entry of judgment affirming the ZBA’s decision in favor of Nelligan and the Town.
