Supreme Court of Louisiana

Lealon Johnson v. Aecom Amentum Government Services

December 18, 2025

Summary

The court held that an injured employee's claim was facially prescribed because the Louisiana Workers' Compensation Law provides no exception merely because the employee continued working at full wages after an immediately manifesting injury. It nevertheless held that the employer tacitly renounced prescription by initiating and regularly paying workers' compensation benefits for approximately two years after the prescriptive period had expired. The court affirmed denial of the prescription exception and remanded for further proceedings.
