Supreme Court of Louisiana
The Council of the City of New Orleans v. Edward Wisner Donation, the Honorable Mayor Latoya Cantrell
March 22, 2024
Summary
The court held that the New Orleans City Council has procedural capacity to sue over the alleged unlawful disposition of City assets under the Home Rule Charter. Reading the Charter as a whole, the court concluded that provisions authorizing the Council to institute suits to protect City interests and to employ special counsel for itself permit the Council to bring this action despite its conflict with the Mayor and Law Department. The judgment was reversed, and the matter was remanded for consideration of issues that the court of appeal had not reached.
