Supreme Court of Louisiana

Succession of Charles George Harlan

May 1, 2018250 So. 3d 220

Summary

The court held that a notarial testament rendered absolutely null by failure to comply with required testamentary formalities cannot operate as an authentic act revoking prior testaments. Because the 2012 document was absolutely null, its revocation clause did not revoke the 2000 statutory testament or the 2007 olographic testament. The court reversed the appellate court, reinstated the district court judgments, and remanded for further proceedings.
