Summary

On remand, the court reconsidered whether the trial judge was constitutionally required to recuse himself because of his prior involvement in an internal investigation concerning a gun possibly connected to the murders. Applying the objective probability-of-bias standard, the court held that the circumstances did not create a constitutionally intolerable risk of actual bias and upheld the prior denial of relief. The court therefore denied the defendant's request for substantive relief and reinstated conviction.
