The court held that New Orleans Municipal Code § 110-11 unconstitutionally restricts protected artistic expression by prohibiting outdoor art sales throughout the city except in narrowly designated French Quarter locations. Although the ordinance is content neutral and serves significant interests in public safety, traffic flow, tourism, and preservation of the French Quarter, it is not narrowly tailored and leaves no ample alternative geographic channel for selling art. The court reversed the lower courts and granted the motion to quash the charging affidavit.
