Kentucky Supreme Court
Jerel Colemon, as Administrator and Personal Representative of the Estate of William Virgil v. Westport Insurance…
December 18, 2025
Summary
The court held that Westport's law-enforcement-liability policies covered personal injuries only when the relevant offense occurred during the policy period. Because Virgil's malicious-prosecution injury occurred when the underlying criminal charges were filed in 1987, and he alleged no independent injury during Westport's 1997–2000 coverage period, the policies were not triggered and Westport had no duty to defend or indemnify Newport. The court affirmed the judgment for Westport.
