Summary

The Court held that the trial court applied the wrong legal standard when it denied Moore the domestic-violence exemption from violent-offender parole restrictions after finding that she was a domestic-violence victim. The court was required to make factual findings about the full history of alleged abuse and then determine, under the totality of the evidence, whether some connection existed between that abuse and Moore's killing of Jackson. The Court reversed the Court of Appeals insofar as it ordered the trial court to grant the exemption, vacated the trial court's order, and remanded for further factual findings and a new determination.
