Kentucky Supreme Court
Alyssa Baum v. Justin Aldava
April 24, 2025
Summary
The court held that Aldava waived his personal-jurisdiction defense by failing to raise it in his first defensive filing. Independently, it held that Kentucky courts may protect Kentucky-domiciled domestic-violence victims and children through protective orders, temporary custody awards, in-state firearm restrictions, and entry of orders into LINK even when the respondent is not subject to personal jurisdiction. The court reversed the Court of Appeals in part and remanded for proceedings consistent with its ruling.
