Kentucky Supreme Court

John Edward Anderson v. Commonwealth of Kentucky

December 19, 2024

Summary

The Kentucky Supreme Court held that the Fugitive Disentitlement Doctrine (FDD) is reviewed de novo as a question of law and that an appellant who voluntarily surrenders to custody before the appellate court asserts jurisdiction is not subject to the FDD. Accordingly, the Court reversed the Court of Appeals’ dismissal and remanded for consideration of the merits of Anderson’s appeal.
