The Kentucky Supreme Court held that KRS 61.102 does not require a whistleblower report to involve a matter of public concern, because the statute's plain language contains no such limitation. It nevertheless held that Rogers's inquiry to a deputy sheriff and her comments to her supervisor were not protected reports, disclosures, or divulgences under the statute, and it reinstated summary judgment for PACS. Noble, J., dissenting, would have affirmed the Court of Appeals because Rogers's report of suspected illegality directly to her supervisor was protected conduct under the statute.
