Summary
The Court held that the University of Kentucky's employee handbook, disability-plan documents, and related policies did not create an enforceable contract for long-term disability benefits because they contained clear disclaimers and reserved the University's authority to modify or terminate the plans. Because the employees had no contract with the University, their claims did not overcome governmental immunity, and the Court affirmed the dismissal of their claims. NOBLE, J., dissenting, would have held that the documents created written unilateral contracts accepted through employee performance and fell within the statutory waiver of immunity.
