Kentucky Supreme Court
Commonwealth of Kentucky v. Charles P. Farmer
February 20, 20142014 Ky. LEXIS 17
Summary
The Kentucky Supreme Court held that the Court of Appeals lacked jurisdiction to hear a criminal defendant's interlocutory appeal from an order denying immunity under KRS 503.085. Neither the Constitution nor Kentucky statutes authorize such an appeal, and the collateral-order exception does not apply because the self-defense immunity issue is intertwined with the merits and does not implicate the required substantial public interest. The court reversed the Court of Appeals and remanded for further proceedings in the trial court.
