Kentucky Supreme Court
Shelby Little, Jr. v. Commonwealth of Kentucky
December 19, 20132013 Ky. LEXIS 634
Summary
The court affirmed Little’s convictions for assault, DUI, driving without a license, and persistent felony offender status. It held that the trial court did not abuse its discretion in refusing to strike two jurors for cause and that the hospital laboratory report was a nontestimonial, properly authenticated business record. The court reversed the wanton-endangerment conviction because prosecution as to one victim was barred by double jeopardy and the combined instruction for two separate victims violated the unanimity requirement; Cunningham, J., dissenting, would also reverse based on the refusal to strike Juror Wright.
