Summary

The court affirmed Young's consecutive life sentences with 50-year minimum terms after concluding that the district judge reasonably denied his request to reduce the minimum terms to 25 years. The court held that neither Young's past criminal activity or criminal history, future-violence risk, adverse childhood experiences, nor remorse and acceptance of responsibility constituted a substantial and compelling reason for departure. The court also held that review of the departure decision is for abuse of discretion, including whether the decision was based on legal or factual error or was unreasonable.
