The court reversed Mora's two alternative felony-murder convictions and vacated his sentence because the evidence did not establish either the specific intent required for attempted aggravated robbery or an intent to distribute marijuana. The court held that the aiding-and-abetting foreseeability instruction was legally inappropriate for the attempted specific-intent offense and that the evidence was insufficient to show Mora intended to participate in a robbery. It also held that purchasing or attempting to obtain marijuana for personal use, without evidence of a later intended transfer, does not establish attempted distribution.
