Summary

The court held that the Elections Clause does not prevent Kansas courts from reviewing congressional redistricting under the Kansas Constitution, but that excessive partisan gerrymandering is a nonjusticiable political question because Kansas has not enacted judicially manageable standards. The court held that Kansas equal-protection protections are coextensive with the Fourteenth Amendment and that plaintiffs failed to satisfy the governing tests for racial gerrymandering or minority vote dilution. The court reversed the district court's judgment and lifted the injunction against the Ad Astra 2 map.
