Summary

The court reversed the district court's judgment invalidating Kansas's congressional redistricting plan and lifted the injunction. It held that state courts may review congressional reapportionment under the Kansas Constitution, but that excessive partisan gerrymandering is a nonjusticiable political question because Kansas has not enacted judicially manageable standards limiting partisan considerations. It further held that Kansas's equal-protection guarantee is coextensive with the Fourteenth Amendment and that plaintiffs failed to satisfy the governing tests for racial gerrymandering or minority vote dilution.
