Summary

The court held that it lacked appellate jurisdiction to review the sentencing judge's decision to impose a consecutive sentence for a felony committed while the defendant was on felony probation instead of finding that consecutive sentences would cause manifest injustice. Although the decision whether to impose concurrent or consecutive sentences is distinct from determining the presumptive term, both decisions arise within the presumptive sentencing guidelines system and are not among the issues made appealable by statute. The court therefore affirmed the Court of Appeals' dismissal for lack of jurisdiction.
