Summary

The court held that the City's agreement to acquire and improve the speedway through STAR-bond financing involved governmental policy-making rather than a proprietary administrative undertaking. Because a municipal governing body cannot bind a successor to governmental policy decisions, the City was not liable for abandoning the agreement, and dismissal of the breach claims was proper. The court reversed the Court of Appeals and affirmed the district court.
