Summary
The court held that the temporary-lodging requirement applies only when a sex offender stays away from the offender’s principal residence for more than five days, and does not apply merely because the offender changes residences. Because the State charged Uranga under the temporary-lodging provision but presented no evidence of more than five days away from either principal residence, the conviction was unsupported by sufficient evidence. The court also concluded that the objected-to marshaling instruction misstated the statutory trigger, vacated the court of appeals’ decision, reversed the district court judgment, and remanded for entry of a judgment of acquittal.
