Summary

The court affirmed summary judgment rejecting a challenge to a school bond referendum because the contestants alleged illegal votes but did not identify the persons who allegedly cast them. It held that the statutory naming requirement applies to school bond election contests and must be strictly complied with because election contests are authorized only by statute. The court therefore concluded that the contest could not proceed regardless of evidence suggesting that out-of-district voters received referendum ballots.
