Supreme Court of Iowa
CMT Highway, LLC, an Iowa Limited Company v. Logan Contractors Supply, Inc., an Iowa Corporation
April 24, 2026
Summary
The court held that a buyer covering after a seller's breach is not required to purchase the same goods from the breaching seller at a higher price. The buyer must nevertheless act in good faith, without unreasonable delay, and make a reasonable purchase, and substantial evidence supported the finding that Logan Contractors satisfied those requirements by obtaining substitute goods from other manufacturers at market prices. The court remanded only to correct the double award of prejudgment interest.
