Summary
The court held that the employer failed to substantially comply with Iowa's statutory requirements for forming a random drug-testing pool because it included its entire employee population rather than excluding employees who were not scheduled or had been excused from work. The employee was aggrieved because he was selected through the defective process, it was impossible to know whether he would have been selected from a compliant pool, and he was terminated as a result. The court therefore awarded the employee summary judgment on the statutory pooling claim and remanded for determination of relief.
