Supreme Court of Iowa
Harvey L. Harrison v. Lisa Mickey
March 14, 2025
Summary
The court held that Des Moines police use-of-force reports are factual incident reports, not confidential personnel records, and therefore are subject to disclosure under the Iowa Open Records Act. It also held that the peace-officer bill-of-rights confidentiality provision does not apply because the reports are routinely prepared after uses of force and are not statements or interviews made in response to complaints. The court affirmed disclosure of the officer-completed portions of the 2020 reports, subject to appropriate redactions and qualifications. No separate opinions were filed.
