Supreme Court of Iowa
Douglas Wilson and Jane Wilson v. Shenandoah Medical Center
May 23, 2025
Summary
The court held that the plaintiffs failed to show good cause for certifying their medical-malpractice expert three months after the statutory and agreed deadline. Defense counsel had no duty to remind opposing counsel of the deadline, and the plaintiffs' expert was therefore barred from testifying. The court vacated the court of appeals' decision, reversed the district court's denial of summary judgment, and remanded for the district court to decide whether expert testimony was necessary to avoid summary judgment.
