Summary

The court held that Iowa's implied-consent procedure is not the exclusive method for investigating suspected operating-while-intoxicated offenses and that officers may obtain a search warrant for a bodily specimen. Although the officer violated the defendant's statutory right to communicate with counsel, suppression of the blood-test results was unwarranted because the warrant application relied on observations and facts independent of that violation. The court therefore reversed and remanded the suppression order.
