Supreme Court of Iowa

State of Iowa v. Bita Amisi

November 17, 2023

Summary

The court held that admitting edited bodycam footage showing Amisi consenting to a preliminary breath test and then being arrested violated Iowa Rule of Evidence 5.403 because the evidence had minimal probative value and strongly implied that he failed the test. The error was harmless in light of the overwhelming independent evidence of intoxication, and sufficient evidence supported the eluding conviction. The court therefore affirmed Amisi’s convictions and sentence.
