Summary

The court held that the qualified-immunity statute did not apply retroactively to Carver-Kimm's common-law wrongful-discharge claim and that her allegations sufficiently pleaded a public-policy claim based on her statutory duty to produce public records. The court nevertheless dismissed both the statutory whistleblower and common-law wrongful-discharge claims against the Governor and her communications director because neither had legal authority to discharge her, while allowing the claims against the State to proceed. The case was remanded for further proceedings.
