Summary

The Indiana Supreme Court held that the Dram Shop Act modified but did not eliminate common-law negligence liability for entities furnishing alcohol. The Act adds requirements of actual knowledge of visible intoxication and proximate causation, both of which the estate sufficiently alleged in its negligence count. The Court therefore affirmed denial of the restaurants’ motion to dismiss. No separate opinions were issued.
