Summary

The Indiana Supreme Court held that abortion providers have standing to challenge Senate Bill 1, that Article 1, Section 1 of the Indiana Constitution is judicially enforceable, and that it protects access to an abortion necessary to protect a woman's life or from a serious health risk. The court held, however, that the Constitution generally leaves regulation of abortions not necessary for those purposes to legislative discretion, so the providers could not prevail on their facial challenge to the entire statute. The court therefore vacated the preliminary injunction and remanded for further proceedings consistent with its opinion.
