Indiana Supreme Court
Hoosier Contractors, LLC v. Sean Gardner
July 19, 2023
Summary
The Court held that Gardner lacked standing to pursue his counterclaim because he presented no evidence that Hoosier's deceptive contract practices caused him actual injury through detrimental reliance. The Court reversed the denial of Hoosier's summary-judgment motion, remanded for dismissal of the counterclaim, and held that the standing ruling mooted the class-action issues while affirming the denial of Gardner's separate partial-summary-judgment motion. The separate concurrence is omitted as directed.
