Summary

The Indiana Supreme Court held that the trial court acted illogically by denying the estate's for-cause challenge to a prospective juror who repeatedly said he could not and would not assess noneconomic damages, expressed uncertainty about his favorable views of doctors, and was not rehabilitated. Because the estate exhausted its final peremptory challenge on that juror and identified another objectionable juror it would have struck, the court held that prejudice was established and ordered a new trial.
