Summary

The court held that warrants to search Heuring’s home and his father’s barn were unsupported by probable cause because the affidavits did not establish that the GPS device was knowingly taken without authorization or that anyone intended to deprive its owner of the device’s value or use. The court also held that the good-faith exception did not apply because reliance on the affidavits was objectively unreasonable. It therefore ordered suppression of both the evidence seized during the initial searches and the derivative evidence obtained through later warrants, and reversed and remanded.
