Indiana Supreme Court
Cavanaugh's Sports Bar & Eatery, Ltd. v. Eric Porterfield
March 3, 2020
Summary
The Indiana Supreme Court held that Cavanaugh’s owed no duty to protect Porterfield from a sudden parking-lot fight because the attack was not foreseeable as a matter of law. The court concluded that no evidence showed Cavanaugh’s had present knowledge of specific circumstances indicating imminent harm, and historical reports of prior incidents could not establish foreseeability for purposes of duty. It therefore reversed and remanded with instructions to enter summary judgment for Cavanaugh’s.
