Indiana Supreme Court

Cathy Jo Robertson v. State of Indiana

March 30, 2020

Summary

The Indiana Supreme Court held that the two‑year statute of limitations for the State’s claims to recover public funds under Indiana Code §5‑11‑5‑1(a) begins when the Attorney General receives the final, verified audit report, and that the Crime Victims Relief Act claim is subject to the discovery rule and therefore untimely. Accordingly, the court affirmed the trial court’s denial of the motion to dismiss Counts I and II, reversed the denial of the motion to dismiss Count III, and remanded for further proceedings.
