Indiana Supreme Court
The Care Group Heart Hospital, LLC v. Roderick J. Sawyer, M.D.
March 23, 2018
Summary
The court held that the phrase “any termination” in the joinder agreement required redemption of the doctor's ownership interest upon any termination of employment, including a termination that breached the employment agreement. The Hospital therefore did not breach by redeeming the interest, but it breached by paying nearly five months late and owed statutory prejudgment interest. The court also upheld the discovery-sanction award because any failure to hold a separate hearing was harmless and the amount awarded was within the trial court's discretion.
