Summary

The Illinois Supreme Court reversed Hagestedt's conviction, holding that police officers' use of a flashlight to view the contents of a locked kitchen cabinet during a warrantless entry for a gas leak constituted an unreasonable search violating the Fourth Amendment and the Illinois Constitution. Accordingly, the evidence obtained was suppressed as fruit of the poisonous tree and the conviction was vacated.
